Record label EMI, which was purchased by Terra Firma Capital Corporation (TII) in 2007, was dealt a serious blow yesterday by the band Pink Floyd. The band filed a lawsuit against EMI because the record company started selling individual music tracks from Pink Floyd's two block buster albums, Dark Side of the Moon and The Wall online. The selling of individual music tracks is expressly forbid by the band's contract with the record label. Yesterday a judge affirmed that contract condition.
This turn of events comes not only as a serious blow to EMI, but as a gut wrenching twist in Terra Firma's continuing downward spiral. Terra Firma is currently engaged in a legal battle with Citigroup, Inc. (C) regarding its purchase of EMI at auction. Terra Firma has accused Citi of the use of "fraudulent measures" in completing that sale.

U.S. consumer electronics behemoth Best Buy Co. Inc. (BBY) will be joining Japan's Panasonic Corp. to unveil and heavily promote newer 3D television sets this quarter. As flat panel televisions continue selling at a decent but middling pace, the "next big thing" in home entertainment is ready to roll off shelves. Best Buy believes it will be 3DTV, apparently.
Panasonic will discount the prices of the rollout models by 50% as it creates demand for the new category using pricing as its primary weapon. But will customers care? Just because Panasonic is trying to reverse losses in its television operating doesn't mean customers will soon adopt a new television technology that is surely to have very limited content. If Panasonic needs a 3D ecosystem of content to push these new televisions, that could be years off.

Instigated by an agreement negotiated between the European Commission (EC) and Microsoft Corp. (MSFT), a new browser selection utility has just become available. Although the browser choice software is intended mainly to be distributed through the Windows update system familiar to Microsoft's Internet Explorer (IE) users, it is also available online for anyone to access.
It is reported that Microsoft IE currently holds approximately 62% of browser market share. That is a powerful position for the company to be in when considering that web browsers are absolutely essential pieces of software. That is, in part, why the EC put pressure on Microsoft to open up the playing field to lesser known browser utilities. With their demands, European regulators essentially cut Microsoft's exclusive IE umbilical cord in July of 2009.

Best Buy (BBY) will be joining Vudu -- which was recently bought by Walmart (WMT) -- Netflix (NFLX), Roxio's CinemaNow, Amazon.com (AMZN) On Demand, and others in streaming video content directly over the Internet to your favorite television set. Details are sketchy so far, but the large question is this: do we need another one of these services? The market is already saturated. What's the benefit?
For one, Best Buy's Reward Zone Premier Solver members will receive one free video rental per month. That's quite a benefit for a customer that spends $2,500 per year at the largest consumer electronics chain in the U.S. -- not. You need to throw a bigger bone to these customers, Best Buy. That's like giving a dime back for every few hundred dollars spent. Not impressive.

Carlos Ghosn, chief executive of Renault (
RNSDF) and Nissan (
NSANY), is looking for a boom in electric car sales by 2011. Speaking at the Geneva Motor Show, Ghosn said: "From everything I'm seeing, in 2011 or 2012 we're going to have to rush to build capacity for both batteries and cars."
Renault and Nissan are installing enough capacity to build 150,000 cars in Japan, 200,000 in Europe and 200,000 in the U.S. They are plunging headlong into the market, claiming to be the first companies to build and sell fully powered electric cars.
Unlike hybrids, such as Toyota's (TM) Prius, electric cars do not have an engine to keep them running when their power runs out.

eBay's (EBAY) purchase of Skype for over a billion dollars years ago was seen by many as obtuse and strange. Did eBay really expect its auction buyers and sellers to want to speak over the Internet (or video conference, for that matter)? Part of the allure of online auctions is the relative anonymity both sellers and buyers have. No "meeting in the parking lot" Cragislist-ish type of meetings in most cases.
But Skype has not paid off like eBay would have hoped. While the purchase of PayPal was the best acquisition eBay ever made, the planned synergies never materialized with Skype. While still a popular voice and video service around the world (ultra-cheap as well), Skype may be posed to bring voice and video calling direct to flat-panel television sets near you soon. The "videophone" concept has never really been that popular, mostly due to the kludgy ways past products have been designed and marketed.
